Wisconsin Supreme Court Reverses Governor’s Use of Face Mask Imposed by Governor

  • (General Dispatch) – This Wednesday, the Wisconsin Supreme Court issued a verdict against Governor Tony Evers for overstepping his authority and requiring the extension of face mask use without the consent of the State Legislature.
  • Obviously, the governor is prohibited from issuing state public health orders. However, any procedure must have the approval of the legislating court.
  • Following the issuance of the 4-3 decision, the use of the face mask is declared not to be appropriate, according to the Supreme Court justices.
  • At the same time, the justices emphasized that Evers has no power to issue state orders concerning the health context.
  • “The question in this case is not whether the governor acted wisely; it is whether he acted lawfully. We conclude that he did not,” wrote Judge Brian Hagedorn.
  • Of note, governors have the power to issue state emergency health orders for 60 days. But with proper legislative approval.
  • Legislators said they were offended by the manner in which the governor’s procedure was carried out, which curtailed their legislative functions.
  • On the contrary, citizens and other competent authorities criticize the Republicans for obstructing an ordinance necessary to continue biosecurity measures in the state.
